Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent to survey, sub-divide and thereby issue a separate patta in the name of the petitioner in respect of Survey No.608/5A2A1A1 situate in Kalarpatti North, Ayyalur Post, Vedasandur Taluk, Dindigul District, based on the representation dated 18.06.2021.

Heard the learned counsel on either side.

2. The petitioner wants the petition mentioned property to be surveyed. She also wants separate patta to be issued in her name.

3. Notice was ordered to the respondent. The respondent submitted that there is a rival claim and O.S.No.19 of 2022 has been filed in this regard before the District Munsif Court, Vedasandur. Therefore, this Court will not be justified in issuing mandamus. It is also noted that the rival party has not been impleaded in this writ petition.

4. Therefore, leaving open all the rights and remedies of the petitioner, this writ petition stands dismissed. No costs. 28.06.2022 Index : Yes / No Internet : Yes/ No PMU 2/4
