PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying this Court to transfer the investigation in connection with complaint dated 03.01.2023 pending on the file of the 2nd Respondent to any other competent authority.

ORDER

This petitioner has filed the present petition to transfer the investigation in connection with complaint dated 03.01.2023 pending on the file of the 2nd Respondent to any other competent authority.

2.On the side of the petitioner, it is stated that the private respondents entered into the house of the petitioner and committed theft of Rs.60,000/- (Rupees Sixty Thousand only) and caused damage to the articles worth about Rs.30,000/-. The respondent police failed to investigate the matter in proper manner and prayed the investigation to be transferred to some other investigating agency.

3.On the side of the prosecution, it is stated that after the investigation, the complaint was closed as it is civil in nature. 4.Since the complaint has been closed, the petitioner is at liberty to question the above said closure.
