PRAYER :- For Bail in Crime No. 201 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused herein, who was arrested on 16.05.2022 for the alleged offence under Sections 294(b) and 307 of IPC, in Crime No.201 of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner used to suspect the fidelity of his wife and frequently, quarrelled with her. On the date of occurrence also, he quarrelled with her and assaulted her and caused head injury. Hence, the present case has been registered against the petitioner.

3.The learned counsel for the petitioner would submit that the petitioner is innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that he is in judicial custody from 16.05.2022. Hence, he seeks to grant of bail to the petitioner.

4.The learned Government Advocate (Crl.Side) would submit that the defacto complainant has sustained severe head injury and seven stitches have been stitched on the head of the defacto complainant. CRL OP(MD). No.10855 of 2022 5.It is seen that after the above said incident, the matter was compromised between the parties. Now, the defacto complainant is staying in the house of the petitioner. Further, the petitioner is not having bad antecedents, except the matrimonial issue. 6.Considering the period of incarceration and subsequent to the development of compromise, this Court is inclined to grant bail to the petitioner with stringent conditions.

7.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate-I, Kulithalai, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
