RESPONDENT / COMPLAINANT For Petitioner : MR.S.XAVIER RAJINI Advocate For Respondent : Mrs.M.ANANTHA DEVI, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 306 of I.P.C., in Crime No.327 of 2018, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the elder sister of the defacto complainant used to travel in the petitioner's auto and when the petitioner attempted to have illegal relationship with her, it was refused by her and hence, on 06.07.2018 at 09.00 a.m., the petitioner has come to her house and threatened her to have illegal relationship with her and hence, the deceased consumed poison at 12.00 p.m. and died.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Government Advocate (criminal side) would submit that the investigation is pending https://hcservices.ecourts.gov.in/hcservices/

5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Eraniel and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
