Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to promote the petitioner as driver in the vacancy of driver post at secnd respondent Office on the basis of proceedings in Na.Ka.No.E4/3078/2022 dated 06.02.2023 on the basis of the petitioner's representation dated 29.04.2024. ORDER

The present writ petition has been filed seeking a Writ of Mandamus to direct the first respondent to promote the petitioner as driver in the vacancy of driver post at secnd respondent Office on the basis of proceedings in Na.Ka.No.E4/3078/2022 dated 06.02.2023 on the basis of the petitioner's representation dated 29.04.2024.

2. Heard Mr.T.Indrachithu, learned counsel for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader appearing for the respondents.

By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself. 4.The petitioner, who was recommended to be promoted to the post of Driver by the second respondent, has filed this writ petition seeking a direction against the first respondent to act upon the recommendation of the second respondent for promoting him to the said post.

5. In the proceedings of the second respondent, dated 06.02.2023, it is seen that the petitioner was found to be senior most among the eligible persons who can be promoted to the post of 3/6

Driver and has recommended the petitioner for the said post. So far, no order has been passed from the end of the first respondent.

6. In the light of the above observation, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's representation, dated 29.04.2024 and pass orders on its own merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. No costs.
