This writ petition has been filed for a mandamus directing the respondent 1 to 5 to grand the compensation award to the petitioner regarding with the Land Acquisition for National Highways 744, in respect of the properties in Survey No. 37/6A, 37/6C, 37/6B, 37/6D situated in Deyvendri Village, Srivilliputtur Taluk, Virudhunagar District

2. Heard the learned counsel on either side.

3. The learned counsel for the 4th respondent would submit that the claim of the petitioner for depositing the compensation would be decided within a period of 12 weeks, taking into consideration of the pending civil suit.

4. The learned counsel for the petitioner would submit that the pending civil suit is nothing to do with the land acquired from the petitioner and it is a separate survey number. However, the said aspect shall be considered while disposing of the petition.

5. Recording the said submission, the 4th respondent is directed to consider the claim of the petitioner for depositing the compensation within a period of 12 weeks from the date of receipt of a copy of this order. Needless to say, while considering the claim, the pending civil suit shall also be taken into consideration. Accordingly, the writ petition is disposed of. There shall be no order as to costs.
