ORDER

This Writ Petition has been filed under the Article 226 of the Constitution of India, to issue a Writ of Quo Warranto, questioning as to the status of the 3rd Respondent under what authority the 3rd Respondent holds the post of General Manager (Offsite&Cements) of TNPL, based on the Petitioner's Representations dated 14.02.2020, 03.03.2020 and 05.05.2020 made to the Respondents 1 and 2.

When the matter was taken up for hearing, Mr.M.P.Senthil, learned counsel for Respondents 2 and 3, produced a letter dated 31.03.2022, stating that Mr. R.P. Arivudainambi, the 3rd Respondent, who served as General Manager of Corporate Technical Coordination, was relieved of his services at the close of office hours on 31.03.2022, upon attaining the age of superannuation, and this letter is already on record. A copy of the said letter was also provided to the learned counsel for the Petitioner.

Mr.P.Krishnasamy, learned counsel for the Petitioner, submits that with the production of the said letter, the issue of quo warranto is concluded, and nothing remains to be decided by this Court. However, he states that the 3rd Respondent had already claimed entire benefits during his service tenure. He seeks permission to withdraw the writ petition with liberty to file a case against him in the future before the appropriate forum, in accordance with law.

After considering the arguments advanced by the learned counsel for the Petitioner and after perusal of the letter dated 31.03.2022, this Writ Petition is dismissed as withdrawn with liberty to the Petitioner to approach the competent forum in accordance with law for redressal of grievances in future, if any. There shall be no order as to costs.
