Respondents Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the first respondent to accord sanction for prosecution in terms of Section 197 of Cr.P.C so as to prosecute the fourth respondent and further direct the second respondent to accord sanction for prosecution in terms of Section 197 of Cr.P.C so as to prosecute the fifth respondent pursuant to my complaint dated 16.07.2021. ORDER

This writ petition has been filed for directing the first respondent to accord sanction to the petitioner for prosecuting the fourth respondent as well as the fifth respondent.

2. The grievance of the petitioner is that at the instance of a private person, the respondents 4 and 5 have been targeting him repeatedly. The provocation for filing the writ petition is registration of Crime No.122 of 2021 on the file of the Kenikkarai Police Station.

3. When the matter was taken up for hearing, the learned Additional Public Prosecutor, on instructions, submitted that Crime No.122 of 2021 has been closed as 'Mistake of fact'.

4. In view of this development in favour of the petitioner, the petitioner has graciously accepted not to pursue his case against R4 and R5. This Writ Petition is disposed of accordingly. No costs.
