Prayer : Review Application Writ filed under Order XXXXVII Rule 1 of C.P.C r/w Section 114 of C.P.C., to review the order passed by this Court in W.P. (MD)No.16001 of 2023 dated 04.01.2024.

ORDER

This review application is filed by the petitioner seeking to modify Paragraph No.6 of the order passed by this Court in W.P.(MD)No.16001 of 2023 dated 04.01.2024, elaborating her difficulty in convincing the 4th respondent to cooperate with her in submitting a joint application together before the 3rd respondent for the purpose of receiving the death benefits of the husband of the petitioner and the 4th respondent and sought permission of this Court to allow her to make a separate application.

2. The learned standing counsel, Mr.P.Gunasekaran, appearing for the 5th respondent, submitted that the proper method itself is for them to 2/5

submit a separate application for the purpose of receiving the death benefits of the Late. Mr. Mohamed Rasheed.

3. In view of the same, the portion of the 6th paragraph in the said order is modified by allowing the petitioner to make a separate application and the 4th respondent is also permitted to make a separate application for the purpose of receiving their respective share in the death benefits of their husband, Mr. Mohamed Rasheed who served as Junior Assistant at the District Treasurer Office, Thanjavur district.

4. The application should be made before the District Treasurer Office at Thanjavur. The petitioner and the 4th respondent are permitted to make an application within a period of one month from the date of receipt of the copy of this order. On receipt of the same, the other respondents are directed to process the application and issue the death benefits of the Late. Mr. Mohamed Rasheed within a period of 60 days thereafter. 3/5

5. With the above terms, this Review Application is disposed of. No costs.
