PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., transferring the investigation of the case in Crime No.50 of 2015 dated 19.02.2015 on the file of second respondent police to the third respondent.

O R D E R

This petition has been filed seeking for transfering of investigation in Crime No.50 of 2015.

2.It is seen from records that the respondent police after investigation, seems to have filed a final report as "undetected". The learned Judicial Magistrate, Nagercoil did not accept this report since a case which is at the stage of "undetected" is only a stage in investigation and the respondent police will have to continue with the investigation.

3.The Court below is directed to proceed further in this matter in accordance with law. The petitioner is also having a grievance with regard to the jewel, that is alleged to have been recovered in this case and it has not been given to the petitioner. 4.Considering the facts and circumstances of the case, liberty is given to the petitioner to work out his remedy before the Court below.

5.With the above directions, this Criminal Original Petition is disposed of.
