Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of MANDAMUS directing the respondents No. 1 to 3 to consider the petitioner's representations dated 16.02.2026 and 12.03.2026 and pass orders to take appropriate action to ascertain whether the 4th and 5th Respondents has illegally changed their spouse name at their passports or filed any application for change of spouse name and take appropriate action.

ORDER

The petitioner is before this Court seeking for a direction to the respondents 1 to 3 to consider the petitioner's representation dated 16.02.2026.

2. In the said representation, the petitioner has called upon the said respondents to ascertain as to whether the respondents 4 and 5 have 2/6

illegally changed the spouse name and in their passports or filed any application for change of spouse name and if found the same, take appropriate action.

3. The petitioner claims to be the legally wedded wife of the fourth respondent and has produced certificate of marriage issued by the Elshaddai Mission Church, Palliyadi. However, in the affidavit at para No.8, the petitioner has stated that the present spouse name mentioned in the passport of her husband is not hers, instead it is his former wife's name, Amalaseeli Sunil.

4. Whether the marriage of the fourth respondent with the said Amalaseeli Sunil has been dissolved in the manner known to law is not forthcoming from the documents appended to the writ petition. 5.Whether the petitioner is the legally wedded wife of the fourth respondent is the matter which cannot be ascertained by the respondent passport authority and it is for the petitioner to approach the jurisdictional civil Court for agitating her claim.

6. In light of the above, this Writ Petition is not entertainable and accordingly disposed of with liberty to the petitioner to approach the jurisdictional civil Court for agitating her claim.

7. There shall be no order as to costs.
