Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 5 to remove the encroachment from Ceylon Burma colony Oorani located in survey Nos.341 and 344, Thamaraki South Village, Sivagangai Taluk, Sivagangai District by cancelling the assignment pattas granted to the respondents 6 to 10 vide patta Nos.1435 (survey No.341/1), 1478 (survey No.341/4), 1456 (survey No.341/5), 1662(survey No.344/6) and 1691(survey No.344/7 respectively issued by the fourth respondent to restore Ceylon Burma colony Oorani to its original condition for the usage of public and cattle/ milch animals and also to increase the groundwater level punja land of the Ceylon Burma colony area as well. 2. This writ petition has been filed on the premise that survey Nos.341 and 344 are water bodies and that the private respondents have committed encroachments thereon.

3. When the matter was taken up for hearing, the learned Special Government Pleader produced a copy of 'A' Register and it is seen therefrom that both survey Nos.341 and 344 have been never classified as water bodies. This writ petition stands dismissed. No costs.
