..Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondent to release the EMD, Security Deposit and pay the retention money amounting to a total of Rs.93,44,896/- in respect of the work order issued through tender process in Roc.No.E1/3209/2015 (CN Mall) and completed on 19.07.2024 within a limited time frame as fixed by this Court.

ORDER

The petitioner is before this Court seeking a direction to the respondent to release the Earnest Money Deposit (EMD), Security Deposit, and retention money, aggregating to a sum of Rs. 93,44,896/-.

2.The petitioner participated in a tender floated by the respondent Corporation for the construction of a Shopping Mall. The petitioner emerged as the successful bidder and was consequently awarded the work under a work order issued by the respondent. 3.According to the petitioner, the work was completed satisfactorily in terms of the contract and the requisite bills were duly submitted. Thereafter, the petitioner submitted a representation seeking release of the Earnest Money Deposit, Security Deposit and retention money.

4.The grievance of the petitioner is that, despite completion of the work and submission of the necessary claims, the respondent Corporation has not released the amounts due and payable without assigning any valid reason.

5.The learned Standing Counsel appearing for the respondent submitted that the petitioner's claim would be examined and that the amount found payable, if any, would be released within the time stipulated by this Court.

6.Recording the aforesaid submission, this Court is of the view that the ends of justice would be met by directing the respondent to consider the petitioner's claim and release the amount found due and payable in accordance with the terms and conditions of the contract. 7.Accordingly, this writ petition is disposed of with a direction to the respondent to verify the petitioner's claim and release the Earnest Money Deposit, Security Deposit and retention money, amounting to Rs.93,44,896/-, if found payable, in accordance with the terms of the work order dated 19.07.2024 and other contractual conditions, within a period of six (6) weeks from the date of receipt of a copy of this order.

8.In the event of failure to release the amount found payable within the aforesaid period, the respondent shall pay interest at the rate of 6% per annum on the amount due from the date of default till the date of actual payment.

9.There shall be no order as to costs.
