PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. to direct the respondents 1 to 4 to give necessary police protection to property in Survey No.354/IB3C1, 354/IB2C3 in Valavandhi Village and to protect the life, limb of the petitioner and his family members on the basis of the petitioner's representation dated 15.06.2022.

ORDER

This Criminal Original Petition is filed for issuing a direction to the respondents 1 to 4 to give necessary police protection to the property in Survey No.354/IB3C1, 354/IB2C3 in Valavandhi Village and to protect the life, limb of the petitioner 1/3

and his family members on the basis of the petitioner's representation, dated 15.06.2022.

2. The learned counsel appearing for the petitioner submitted that the petitioner purchased the property in S.Nos.354/1B3C1, 354/1B2C3 to the extent of 1 1⁄2 acres situated at Musiri Taluk from Marudhai, Seenivasan and Lakshmi and he has also obtained patta in pursuance of the sale deed and in possession. The adjacent land owner viz., Subramaniyan / 5th respondent trespassed into the property on 15.06.2021 and damaged the fences worth about Rs.27,000/- . Hence, the petitioner gave complaint before the 4th respondent police and he received the complaint in CSR.No.164 of 2021.

3. The learned Government Advocate (Crl. Side) appearing for the respondents police would submit that the complaint has been registered in CSR.No.164 of 2021 and the enquiry is going on. Further, it is brought to the knowledge of the police that one civil suit is pending in O.S.No.37 of 2021 before the District Munsif Court, Musiri.

4. Per contra, the learned counsel appearing for the petitioner submitted that the petitioner is not a party to the suit.

5. Recording the submissions, the 4th respondent is hereby directed to consider the complaint of the petitioner, dated 15.06.2022 and to take suitable action within a period of two weeks from the date of receipt of a copy of this order.

6. With this direction, this Criminal Original Petition is disposed of.
