Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, to transfer the investigation in Cr.No.2559 of 2024 dated 11.12.2024 on the file of the 2nd respondent, to any other competent investigation agency or officer to conduct further investigation, within a stipulated time that may be fixed by this Court. ORDER

The petitioner with a grievance that the respondent police have not conducted the investigation properly has filed this petition for transfer of investigation.

2.The learned Counsel for the petitioner submits that the petitioner had availed a loan of Rs.13,50,000/- from Union Bank of India, in the year 2015. The said loan amount was not credited into his account, but was credited into someone else's account, it was collected by the manager himself and was not paid to the petitioner. The petitioner lodged a complaint in the year 2015, but no action was taken. Therefore, he reported it before the District Collector, who had conducted enquiry and based on the enquiry action was taken against the bank manager concerned. The District Collector also directed the Deputy Commissioner of Police to look into the issue. Based on the said direction, though a case was registered by the respondent police, no proper investigation has been conducted.

3.The learned Additional Public Prosecutor appearing for the respondent police submits that the petitioner had availed loan and he had also withdrawn the money through cheques. Those cheques have been collected and sent for experts opinion and based on the report from the experts opinion, they would proceed further.

4.Considering the grievance of the petitioner that his complaint of the year 2015 has been registered that too at the instance of the District 2/4

Collector in the year 2024, the Deputy Commissioner of Police concerned shall ensure that proper investigation is conducted in this case. 5.This criminal original petition is closed with the above direction 11.06.2025 DSK To 1.The Commissioner of Police, Trichy City, Trichy.
