O R D E R
This petition has been filed to direct the respondent Nos.1 to 6 herein not to harass the petitioner under the guise of the enquiry in pursuance to the compliant lodged by the seventh respondent. 2.The case of the petitioner is that he fell in love with the seventh respondent herein and their marriage was performed on 12.11.2010. After their marriage, they were living at Velacherry, Chennai. Out of the wedlock the couples were blessed with a male child namely Aneesh. Thereafter, the seventh respondent developed illegal intimacy with one Venkat. Now, their minor child is under the custody of the petitioner.
3.Seventh respondent has lodged a compliant before the fifth respondent police herein, by stating that the petitioner said to have kidnapped her son.
4.It is seen that now the child is under the custody of the petitioner. Since the dispute between the husband and wife with regard to the custody of the child, the respondent police does not make any enquiry.
5.The learned Additional Public Prosecutor submitted that based on the compliant given by the seventh respondent, enquiry was undertaken and the petitioner was called for enquiry, to know the where about of the child. Except the investigation purpose, the petitioner was not called by the investigating officer. 6.In view of the above, there will be no question of harassment. Recording the aforesaid submission of the learned Additional Public Prosecutor, this Criminal Petition is disposed of.
