ORDER : The Court made the following order :- The petitioners, who are the accused in this crime, apprehending arrest at the hands of the respondent Police for the offences punishable under Sections 420, 466, 468 and 506(ii) of the Indian Penal Code in Crime No.Not Known of 2020, on the file of the respondent Police, seek anticipatory bail.
2. When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the respondent Police, on instructions, submitted that petition enquiry is pending against the petitioners.
3. In reply, the learned Senior Counsel appearing for the https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL.O.P.(MD). No.10331 of 2020 petitioners would submit that the first petitioner herein has also given a complaint against the defacto complainant, which is also pending enquiry with the respondent police.
4. In view of the submission made on either side, the respondent Police is directed to conduct enquiry on both the complaints filed by the first petitioner as well as the defacto complainant herein and complete the same, within a period of four weeks from the date of receipt of a copy of this order and if any prima facie case is made out, the respondent police shall register the First Information Report or close the petition enquiry. Till then, the respondent police is directed not to arrest the petitioners.
