For Respondent : Mr.M.Veerandhiran, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.926 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/accused No.4, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323, 324, 342, 392 and 506(ii) IPC, in Cr.No.926 of 2022, seeks anticipatory bail.
2.The case of the prosecution is that on 08.06.2022 at about 08.30 p.m., after completing farewell decoration at college, the defacto complainant and his two friends return back to their home and at that time, the petitioner along with other accused attacked the defacto complainant and his two friends by stones and had stolen their valuables and abused them in filthy language and also threatened them with dire consequences. CRL OP(MD). No.10912 of 2022 petitioner is innocent and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate(Crl.Side) strongly opposed this petition on the ground that the investigation in this case is not completed and the properties are not yet recovered and the custodial interrogation of the petitioner is must necessary in this case.
5.Considering the seriousness and gravity of the allegations levelled against the petitioner and also considering the fact that the investigation is pending and also the fact that the custodial interrogation of the petitioner is required in this case, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 20/09/2022 / TRUE COPY / /09/2022 Sub-Assistant Registrar (C.S.)
