Respondents (In Crime No.1227 of 2020) Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to release the petitioner's vehicle of Tractor bearing registration No.TN 50 C 9241, with nil number Trailer from the custody of the 3rd respondent in respect of Crime No.1227 of 2020 dated 25.08.2020 to the petitioner by considering the petitioner's representations dated 30.08.2020 and 19.09.2020 within the time limit that may be stipulated by this Court.

Heard the learned counsel on either side. By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.

2. This writ petition has been filed seeking release of the petition mentioned vehicle.

3. The learned Additional Government Pleader states that the vehicle has already been produced before the jurisdictional criminal Court. Therefore, the petitioner has to necessarily move the jurisdictional Court for return of vehicle. I make it clear that I have not gone into the merits of the matter. W.P.(MD)No.12898 of 2020 petition is dismissed. The petitioner is given liberty to move the jurisdictional Court. As and when the petition is filed, the same will be disposed on merits and in accordance with law by the jurisdictional Court within a period of ten days thereafter. No costs.
