PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a writ of certiorari to call for the records pertaining 1/4

ORDER

The petitioner has filed this writ petition challenging the show cause notice on the ground that the authority who issued this show cause notice is not having jurisdiction and the petitioner has attributed malafides.

2.When this writ petition has been taken up for hearing, the learned Special Government Pleader appearing for the official respondents submits that the Principal is the competent authority to issue show cause notice and in this case the Principal only has issued the show cause notice. The Principal / 5th respondent against whom the petitioner made allegations has also retired from service. 2/4

3.Since it is confirmed that the Principal is having authority to take disciplinary proceedings and the said Principal against whom the petitioner has made allegations is also not in service now, this writ petition is closed with a direction to the respondents to proceed with the disciplinary proceedings and conclude the same as expeditiously as possible. No costs. Consequently connected miscellaneous petitions are closed.
