O R D E R

Alleging disobedience of the order passed by this Court in W.P.(MD)No. 15986 of 2020, dated 05.10.2023. the present Writ Petition has been filed.

2. The learned Special Government Pleader appearing for the respondent submitted that the order passed by this Court dated 05.10.2023 has been complied with and to that effect he has produced a copy of the proceedings of Methukummal Village Panchayat, Munchirai Union, Killiyoor Taluk, Kanyakumari District, dated 22.08.2024 before this Court.

Per contra, the learned counsel appearing for the petitioner submitted that though this Court by order dated 05.10.2023 in W.P.(MD)No.15986 of 2020, directed the respondent to enquire the petitioner and the fifth respondent therein, without conducting any enquiry, the proceedings dated 22.08.2024 has been passed by the respondent as per his own desire.

4. On a perusal of the order passed by this Court in W.P.(MD)No.15986 of 2020, dated 05.10.2023, it is seen that this Court directed the respondent to 2/4

enquire the petitioner and the fifth respondent therein and thereafter proceed further strictly in accordance with law. Except that, there is no positive direction. Therefore, now the petitioner cannot contend that the order has been passed by the respondent as per his own desire. It is for the authority to take action as per the law and pursuant to the order passed by this Court, now they issued the show cause notice to the person concerned.

5. Accordingly, the Contempt Petition is closed. There shall be no order as to costs.
