PRAYER: Contempt Petition filed under Section 11 of the Contempt of Courts Act, praying this Court, to initiate contempt proceedings against to punish the Contemnors/ Respondents for wilful disobedience of the order of this Court in WP(MD) No.17942 of 2019, dated 20.12.2023, under the contempt of Courts Act. This contempt petition is filed that the order of this Court in WP(MD) No.17942 of 2019, dated 20.12.2023 has not been complied with.

2.Today(10.01.2025), when this contempt petition is taken up for hearing, the learned Additional Advocate General, assisted by the learned Special Government Pleader appearing for the respondents submits that as against the order of this Court in WP(MD) No.17942 of 2019, dated 20.12.2023, the respondent Department has filed a writ appeal before the Division Bench of this 2/5

Court, however, with a delay of 30 days and an application in CMP(MD) No.7621 of 2024 in WA(MD) SR.No.33945 of 2024 is also filed to condone the delay of 30 days. The learned Additional Advocate General further submits that this petitioner has also entered appearance in the application filed for condonation of delay before the Division Bench. The learned Additional Advocate General has also relied upon a letter dated 03.12.2024, which was submitted, insisting the Registry to list the application filed for condonation of delay for hearing at the earliest. 3.Considering the steps taken by the respondents in preferring an appeal as against the order passed by this Court in WP(MD) No.17942 of 2019, dated 20.12.2023 and considering the period of delay, this Contempt petition is closed with liberty to this petitioner to work out his remedy, on the outcome of the writ appeal. 10.01.2025 Index:Yes/No Internet:Yes/No vrn 3/5
