Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records passed by the first respondent in No.1016/thaku.2/2026 dated 01.04.2026 and quash the same as bad in law and in the nature of writ directing the respondent Nos.1 and 2 to grant emergency leave for a period of six days to the petitioner's husband, namely, Devadoss @ Rasul Sulthan s/o. Ponniah, C.P.No.1800 (PID:511821).

O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the impugned proceedings of the first respondent made in No.1016/thaku.2/2026 dated 01.04.2026 and for a direction to the respondents to grant six days emergency leave to the petitioner's husband, who is presently serving sentence at Central Prison, Madurai.

2. Heard the learned counsel on either side.

3. On carefully going through the order passed by the first respondent, it is seen that the first respondent on going through the representation found that the ground that has been raised does not fall within the parameters prescribed under the relevant Rules for grant of emergency leave. In view of the same, the order passed by the first respondent cannot be held to be illegal.

4. The learned counsel appearing for the petitioner submitted that presently there is an emergent ground available to the petitioner to seek for emergency leave.

5. In the light of the above submission, it is left open to the petitioner to make a fresh representation before the respondents by making out the ground for emergency leave and on receipt of such representation, the same will be considered on its own merits and in accordance with law.
