PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus, directing the respondents 2 and 3 to survey and issue patta in the names of the petitioner and his elder sister Karupayee, in respect of Survey No.243/2 measuring 0.39 cents, Survey No.246 measuring Acre 1.89 cents, Survey No. 235/1 measuring Acres 17.8 cents, totaling Acres 20.8 cents, situated at Athanur Village, Thirumayam Taluk, Pudukottai District, by cancelling the Patta No.1153, 1160, 1417, 1107, 1152 and 1423 pursuant to the petitioner's online application dated 27.06.2024. Heard Mr.M.Senthil Kumar, learned Counsel appearing for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader appearing for the respondents.
2.The grievance of the petitioner is that the petitioner has approached the second respondent seeking cancellation of patta issued in the names of the siblings of the petitioner's father. 2/5
3.A question was put to the learned Counsel for the petitioner as to why the said persons were not impleaded as respondents. Learned Counsel submits that even before the second respondent, enquiry has been conducted and notices have been issued to the said persons and therefore, no prejudice would be caused by seeking a direction to dispose of the petitioner's representation. 4.Considering the fact that the second respondent is seized of the matter, a direction is issued to the second respondent to conclude the pending enquiry proceedings, after affording a fair opportunity to the petitioner and also other interested parties and pass final orders within a period of eight [8] weeks from the date of receipt of a copy of this order.
5.Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs.
