O R D E R

This Writ Petition has been filed for the issue of Writ of Mandamus directing the first respondent to take legal action against the second respondent and her husband and effectively to stop the illegal activities in the grama panchayat based on the representation made by the petitioner on 23.06.2021.

2.Heard Mr.P.Thinesh, learned Counsel appearing on behalf of the petitioner, Mr.R.Baskaran, learend Additional Advocate General assisted by Ms.J.Jeyapriya, learned Government Advocate appearing on behalf of the first respondent and Mr.M.S.Jeyakarthick, learned Counsel for the second respondent.

3.In the connected Writ Petition in W.P.(MD)No.18815 of 2021, the first respondent had filed a counter affidavit and the relevant portion 2/4

in the counter is extracted hereunder:

"I humbly submit that the petitioner has made allegations against the President and husband of the President namely Thangaraj, the 3rd respondent herein that he is interfering with the administration of the Panchayat. Hence, the Assistant Director (Panchayats), Dindigul District by his letter dated 25.01.2021 in Na.Ka.No. 2870/2020/A4 called for a report from the Block Development Officer (Village Panchayat), Natham Panchayat Union regarding the allegations made against the Panchayat President and her husband. Pursuant to the same an explanation was sought for from the Panchayat President and an enquiry was conducted with the Panchayat Secretary. The explanation of the Panchayat President and the reports of the Zonal Deputy B.D.O. and the Panchayat Secretary were considered.

Having satisfied with the said explanation and reports, no action has been initiated against the Panchayat President and her husband. In regards with the allegation of signing of cheque by the husband of the Panchayat President, no mismatching in signature was found by the bank officials and hence the said allegation was concluded as false one."

In the light of the above stand taken by the first respondent, no further orders can be passed in this Writ Petition. Accordingly, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
