This Writ Petition has been filed for a Mandamus seeking for a direction to the second and third respondents to renew the petitioner's employment Registration No.TCD2004M00008120 by restoring the same in the register of the third respondent employment exchange with the same seniority as from the date 17.06.2004 and direct the second respondent to take appropriate action against the third respondent by considering the petitioner's representation dated 21.02.2019.
2.A counter affidavit has been filed by the third respondent stating that the inadvertent mistake committed by the respondents in the Register of the third respondent employment exchange pertaining to the petitioner has been rectified and seniority of the petitioner as per his registration has been restored. However, learned Counsel for the petitioner is not satisfied with the contents of the counter affidavit. Admittedly, no final orders were passed on the 2/6
petitioner's representation dated 21.02.2019, given by him prior to the filing of this writ petition.
3.No prejudice will be caused to the respondents if the petitioner is allowed to give a fresh representation seeking for the very same request that has been made in his earlier representation dated 21.02.2019 given prior to the filing of this Writ Petition and a direction is issued to the respondents to consider the said representation on merits and in accordance with law after affording one personal hearing to the petitioner within a time frame to be fixed by this Court.
4.For the foregoing reasons, this Court directs the petitioner to submit a fresh representation seeking for renewal of his employment registration number in Registration No.TCD2004M00008120, by restoring the same in the register of the third respondent employment exchange with the same seniority as from the date 17.06.2004, to the third respondent within a period of two [2] weeks from the date of receipt of a copy of this order. On receipt of the same, the third respondent shall forward the same to the Deputy Director of District Employment Exchange, Trichy District, who shall pass final orders on merits and in accordance with law after affording one opportunity of personal hearing to the petitioner within a period of twelve [12] weeks, thereafter. 3/6
