ORDER

This writ petition has been filed seeking the issuance of a Writ of Mandamus directing the 1st respondent to issue a No Objection Certificate (NOC) for the property measuring an extent of 1692 sq. ft., situated in Survey Nos. 140/4A, 2/6

140/4B, 141/1, and 140/4A1AA3A, located at Sakthi Nagar, Koothur Village, Manachanallur Taluk, Trichy District. Consequently, a direction is also sought to the 7th respondent, namely the Tahsildar, Manachanallur, to issue patta for the said extent of 1692 sq. ft.

2. The contention of the petitioner is that he purchased the property, bearing Plot No. 18, measuring an extent of 2240 sq. ft., on 29.11.2002, situated in the above-mentioned survey numbers. Subsequently, the Government of Tamil Nadu acquired an extent of 549 sq. ft. (i.e., 51 square meters) out of the total extent of 2240 sq. ft. (i.e., 208.103 square meters) on 15.03.2019 for the purpose of laying National Highways. Thus, the remaining extent of 1692 sq. ft. is left with the petitioner.

When the petitioner approached the Tahsildar, the 7th respondent informed him that he is entitled to patta only to the extent of 761.23 sq. ft. and not for the entire remaining extent of 1692 sq. ft. It was also stated that the 1st respondent has to issue a No Objection Certificate, after which the petitioner's application would be considered. Hence, this writ petition has been filed. 3/6

4. The petitioner had already submitted an application to the 1st respondent. However, it is stated that the petitioner has only submitted a representation to the District Collector and other revenue authorities.

5. Therefore, the petitioner is directed to submit a fresh representation to the 1st respondent within a period of four weeks from the date of receipt of a copy of this order. Upon receipt of such representation, the same shall be considered by the 1st respondent in accordance with law, if all parameters are in favour of the petitioner. The 1st respondent shall issue the No Objection Certificate accordingly. Thereafter, the petitioner shall submit a representation to the revenue authorities, who shall consider the same at the earliest.
