ORDER : The Court Made the following order :- The petitioners/A1 to A5, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498 (A), 406, 294(b) and 506(i) of I.P.C. and Sections 3(1), 4 and 6 of Dowry Prohibition Act, in Crime No.17 of 2018 on the file of the respondent police, seek anticipatory bail.
2.The case of the prosecution is that the first petitioner is the husband of the defacto complainant and the 2nd and 4th petitioners are his parents and 3rd and 5th petitioners are his brothers and the first petitioner demanded dowry on the instigation of the petitioners 2 to 5. Hence, the complaint. 3.The learned counsel appearing for the petitioners would submit that the petitioners are an innocent persons and they have been falsely implicated in this case.
4.The learned Government Advocate (criminal side) would submit that it is a matrimonial dispute and the investigation is pending. https://hcservices.ecourts.gov.in/hcservices/
5.Taking note of the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.2, Kuzhithurai and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police, as and when required for interrogation. The petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. 6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
