Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to settle all the retirement and monetary benefits along with 18% interest within the period that may be stipulated by this Court by considering the petitioner's representation dated 08.05.2024.

ORDER

The present writ petition has been filed seeking a Writ of Mandamus to direct the respondents to settle all the retirement and monetary benefits along with 18% interest within the period that may be stipulated by this Court by considering the petitioner's representation dated 08.05.2024.

2. Heard Mr.M.E.Ilango, learned counsel for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader appearing for the respondents.

3. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.

4. The petitioner was allowed to retire subject to certain charges pending against him on 30.01.2023, in his capacity as Manager (Engineeringg), Tirunelveli District Co-operative Milk Producers Union. It is submitted that no charges are now pending against him. It is submitted that the petitioner was exonerated from the earlier charges, which were pending against him and hence, there is no reason for the respondents to withhold the terminal benefits.

5. In such case, there cannot be any hurdle for the respondents to consider the representation of the petitioner.

6. In the light of the above observation, this writ petition is disposed of with a direction to the respondents to consider the petitioner's representation, dated 08.05.2024 and pass orders on its own merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. No costs.
