For Respondent : Mr.P.Kottai Chamy, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 180 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent Police, for the offence punishable under Sections 294(b), 427 and 506(ii) IPC in Crime No.180 of 2021, on the file of the respondent Police, seeks anticipatory bail.

2. The petitioner is the son-in-law of the defacto complainant. Since the petitioner harassed his wife, she left from the matrimonial house and now, she and her child is living along with her parents. On 21.07.2021, at 3.00 p.m. the petitioner came to the house of the defacto complainant in a drunken mood, abused him and his wife and throw the stones on the door of his house. In order to protect themselves, they closed the door of the house. Thereafter, the petitioner damaged his two-wheeler standing in front of the house and also took away a drilling machine worth about Rs.18,000/-. Hence, the complaint.

3. The learned counsel for the petitioner submits that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) opposed for grant of bail on the ground that the drilling machine is yet to be recovered from the petitioner.

5. Since the stolen property is yet to be recovered from the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
