O R D E R

The petitioner seeks the expeditious disposal of an application filed by him under Section 23(1) of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (in short "Senior Citizens Act, 2007").

2. The petitioner asserts that he was the owner of a property in Survey No.2341 admeasuring about 5576 Sq.Ft. The petitioner alleges that his second son, namely, the second respondent herein represented to the petitioner that he would look after the petitioner and on the basis of such representation, the petitioner executed a settlement deed dated 05.06.2020 in favour of the second respondent. Subsequently, the second respondent has failed to look after the petitioner and his wife and instead has taken steps to demolish the marriage hall situated at the aforementioned property. In these circumstances, the petitioner filed a petition before the first respondent under the Senior Citizens Act, 2007. In spite of the lapse of considerable time, it is stated that the said petition has not been disposed of.

3. Given the limited scope of the present petition, it would suffice to issue a direction to the first respondent to dispose of https://hcservices.ecourts.gov.in/hcservices/ 1/2

Accordingly, W.P(MD).No.13522 of 2021 is disposed of by directing the first respondent to consider and dispose of the petition dated 23.02.2021 within a period of three months from the date of receipt of a copy of this order after providing a reasonable opportunity to the petitioner, the second respondent and any others who would be affected by such decision. There will be no order as to costs.
