ORDER

This writ petition has been filed seeking a Writ of Mandamus, directing the third respondent to consider the petitioner's representations dated 31.08.2020 and 23.07.2021, to remove the names of the respondents 5 to 7 and, consequently, cancel the sale deed made based on the false UDR patta entry.

2. Heard the learned counsel appearing for the parties.

3. According to the petitioner, the names of the respondents 5 to 7 have been wrongly included in the revenue records based on a false UDR patta entry. Consequent to the erroneous patta entry, a sale deed has been executed, which, according to the petitioner, is illegal and liable to be cancelled. Hence, the petitioner has sent the representations dated 31.08.2020 and 23.07.2021 to remove the same and cancel the sale deed made based on the false UDR patta entry. Despite submitting representations, the same have not been considered so far, necessitating the filing of the present writ petition.

The learned Additional Government Pleader appearing for the official respondents submits that, in the present case, the District Revenue Officer, Thanjavur District, is the competent authority to consider the grievance raised by the petitioner. It is further submitted that if the petitioner submits a fresh representation ventilating all his grievances before the District Revenue Officer, Thanjavur District, the same will be considered on merits and in accordance with law.

At this juncture, the learned counsel for the petitioner submits that the petitioner is willing to submit a fresh representation before the District Revenue Officer, Thanjavur District, setting out all his grievances in detail. The learned counsel further prays that this Court may be pleased to fix a time frame for consideration of such representation.

6. In view of the above, this Court suo motu impleads the District Revenue Officer, Thanjavur District, as the eighth respondent in the present writ petition.

7. Considering the above submissions, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with the following directions:- (i) The petitioner is directed to submit a fresh representation to the eighth respondent / District Revenue Officer, Thanjavur District, ventilating all his grievances, within a period of two weeks from the date of receipt of a copy of this order.

(ii) Upon receipt of the said representation, the eighth respondent / District Revenue Officer, Thanjavur District, shall consider the same and dispose of it on

merits and in accordance with law, after affording a reasonable opportunity of hearing to the petitioner, the respondents 5 to 7, and any other persons who may be affected by such decision, within a period of fourteen weeks thereafter. There shall be no order as to costs.
