Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the first respondent vide proceedings in No.RO.TRY/650/2025-CA, dated 07.04.2026 and quash the same as illegal and consequently direct the first respondent to grant 28 days ordinary leave without police escort to the petitioner's husband, namely, Ramachandran, S/o. Elangovan, aged about 36 years, Life Convict Prisoner, PID No.174448, confined at Central Prison, Trichy. O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This writ petition has been filed challenging the proceedings of the first respondent made in No.RO.TRY/650/2025-CA, dated 07.04.2026, wherein, the first respondent, while granting 28 days ordinary leave, has imposed a condition that the convict will be accompanied by an escort.

2. Heard the learned counsel on either side.

3. The petitioner is the wife of the convict and the petitioner's husband, who is a life convict, is undergoing sentence at Central Prison, Trichy. A representation was made to the respondents seeking for ordinary leave. The first respondent, while granting ordinary leave through the proceedings dated 07.04.2026, imposed a condition that the convict will be accompanied by an escort. The said condition has been put to challenge in the present writ petition.

Taking into consideration the facts and circumstances of the case and considering the reasons assigned seeking for ordinary leave, this Court is inclined to modify the condition to the effect that the detenu shall report before the fourth respondent every day at 06.00 p.m., during the entire ordinary leave period. Apart from that condition, the detenu is permitted to execute the sureties before the Superintendent of Prison, Trichy, instead of executing the sureties before the Tahsildar and two sureties shall be the family members of the detenu. The other conditions imposed by the first respondent shall stand as it is.
