PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents to consider the petitioner's representation dated 17.12.2018 and make entry on the fraudulent, sale deed in document Nos. 2224/2010 and 2425/2010 dated 14.05.2010 and further to direct the 3rd respondent to register the sale deed or any other document presented by the petitioner relating to his property as per instructions of 1st respondent in Letter No. 41530/U1/2017 dated 31.07.2018. ORDER
This writ petition is filed to direct the 3rd respondent to cancel the sale deed documents in document Nos.2224/2010 and 2425/2010 dated 24.05.2010 and to direct the 3rd respondent to register the sale deed or any other document presented by the petitioner, in respect of the plots in Polt Nos.314 and 315 in S.No.38/5 situated in Mekkudi Village, Srirengam Taluk, Trichy 1/3
District, by considering the petitioner's representation dated 17.12.2018.
2.The grievance of the petitioner is that though he made a representation dated 17.12.2018, to the respondents with the relief sought for in the prayer, so far, no action has been taken. Hence, the petitioner is before this Court.
3.In reply, the learned Government Advocate appearing for the respondents would submit that the petitioner's representation dated 17.12.2018, would be considered on merits and in accordance with law, within a time frame to be fixed by this Court. 4.It is seen from the records that no counter affidavit is filed. Based on the records available and by considering the limited scope of the prayer made by the petitioner and the submissions made on either side, this Court, without expressing any opinion on the merits of the petitioner's case, is inclined to pass the following direction:- The 3rd respondent is directed to consider the petitioner's representation dated 17.12.2018 and pass appropriate orders on merits and in accordance with law, after affording opportunity of hearing to the petitioner and the interested parties, if any, within a period of twelve weeks from the date of receipt of a copy of this order;
5.With the above direction, this Writ Petition is disposed of. No costs.
