Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 3 herein to remove the entry relating to the sale deed registered as Document No. 269/2021, dated 10.02.2021 on the file of the third respondent from the registration records and consequently, declare the same as fraudulent and void, and direct necessary entries to be made in the encumbrance certificate. 1/4

ORDER

When the matter came up for hearing, the petitioner appeared in person before this Court. She submitted that eventhough she filed the earlier round of writ petition, this writ petition was not filed by her. She did not sign the vakalat or the affidavit filed in support of the writ petition. Her maternal uncle, namely, Muthuram, had high-handedly done the mischief, but she does not want action against him.

2. The learned counsel appearing on behalf of the petitioner would submit that when the signed affidavit was duly brought in, especially the writ petition being the second round of the writ petition, the same was filed.

3. The learned counsel appearing on behalf of the private respondent would not oppose any lenient view that this Court may deem fit to take while disposing of the writ petition.

4. Taking a lenient view on the person who had brought the alleged signed papers and without undertaking any detailed enquiry as to whether the petitioner signed or whether the maternal uncle signed on his own, since the petitioner submits that she has not filed and she is not interested in pursuing the matter, the Writ Petition is closed.
