1.T.Lakshmi 2.T.Suresh 3.Pasupathy ... Respondents PRAYER: Petition filed under Article 227 of the Constitution of India, to set aside the fair and decreetal order in I.A.No.43 of 2013 in O.S.No.23 of 2013 dated 07.04.2018 on the file of the Learned Sub Court of Palani.
For petitioner : Mr.V.OM Prakash
O R D E R
*********** The plaintiff in the suit is the revision petitioner herein. He took out I.A.No.43 of 2013 for attaching the defendants property before judgment. The grievance of the revision petitioner is that during the pendency of I.A., the property in question was alienated. Ofcourse, the conduct of the defendants is to be condemned. But then, the fact remains that the I.A., had become infructuous. These transactions had taken place in July, 2014. More than 4 years have gone by.
2. Therefore this Court is of the view that nothing really survives for adjudication in this Civil Revision Petition. But if there is any other property still available, the Court below shall take immediate steps to attach the same, taking note of the conduct of the defendants. The suit shall also be speedily disposed of in any event, within a period of three months from the date of receipt of a copy of this order.
3. With this direction, this Civil Revision Petition is dismissed. No costs.
