For Respondent : M/s.P.Kottai Chamy Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.148 of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 380 of IPC in Crime No.148 of 2021, seeks anticipatory bail. 2.The defacto complainant is a Junior Telecom Officer, BSNL Kallal Exchange. She lodged a complaint against the petitioner on 15.07.2021 stating that the petitioner/contract labourer has taken away 12 to 15 Kgs of copper plates from the Office. 3.The learned counsel for the petitioner submits that the petitioner is an innocent person, he is falsely implicated in this case and the petitioner is also ready to co-operate for the investigation.

4. Considering the submissions of the learned counsel for the petitioner that the petitioner is ready to co-operate for the investigation, this Court by earlier order dated 11.08.2021, granted interim anticipatory bail for a period of two weeks and directed the petitioner to appear before the respondent Police for investigation.

5. The learned Government Advocate (Crl.Side) appearing for the respondent Police, on instructions, would submit that the petitioner did not appear for enquiry.

6. The learned counsel for the petitioner disputed the same and submitted that when the petitioner went and appeared before the respondent Police, the respondent Police insisted for the copy of the order.

7. Considering the rival submissions, nature of offence and the fact that the copper plates are yet to be recovered, this Court is not inclined to grant anticipatory bail to the petitioner.
