PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records relating to the impugned auction notice of the first respondent in C.O./REC/NPA/2022 dated 10.05.2022 and quash the same and consequently direct the respondents to provide further time to pay installments.

2. Today, when the matter is taken up for hearing, the learned standing counsel appearing for the respondent bank, on instructions submitted that the sale as scheduled has not taken place for want of bidders and the prayer in this writ petition has become infructuous.

3. Recording the submission of the learned standing counsel appearing for the respondent bank, this writ petition is dismissed as infructuous. However, liberty is given to the petitioner to approach the bank for any kind of settlement to avoid sale of the property. No Costs. Consequently, connected miscellaneous petition is closed.
