PRAYER :- For Bail in Crime No.68 of 2023 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Accused who was arrested and remanded to judicial custody on 03.03.2023 for the offence punishable under Section 174 of Cr.P.C @ 302 of IPC in Crime No.68 of 2023, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the deceased is the paramour of the petitioner herein. Suspecting the character of the deceased, the petitioner herein assaulted her and murdered her Hence, the complaint.
3.On the side of the petitioners, it is stated that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the deceased in this case was known to him and at times she asked for some financial help from the petitioner and he has also done on sympathy and except this there was no other relationship between the petitioner and the deceased. It is also further stated that the petitioner is in judicial custody from 03.03.2023, hence he seeks bail. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.8461 of 2023 4.On the side of the prosecution, it is stated that petitioner is the sole accused and he is the Special Sub Inspector of Police. Suspecting the character of the deceased he committed the murder. Further the petitioner is having two previous cases of which one case is of similar nature, which is pending in Crime No.450 of 2015. Investigation is still pending in this case, hence he objected to the grant of bail to the petitioner.
5.Considering the facts and circumstances of the case and also the fact that the investigation is still pending and also taking note of the previous bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
6. Hence the petition stands dismissed.
