PRAYER :- For Bail in Crime No. 257 of 2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Accused herein, who was arrested on 10.06.2022 for the alleged offence under Sections 147, 148, 324, 307 IPC, in Crime No.257 of 2022, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the defacto complainant is running a petty shop near Tasmac. On 09.06.2022, at about 07.00PM, there was a wordy quarrel between the first accused and the defacto complainant. At about 08.00PM, all the accused persons went to the shop of the defacto complainant and assaulted him and his brother with sickle. Hence, the case.
3.The learned counsel for the petitioner submitted that for the very same occurrence, a case in Crime No.256 of 2022 has also been registered on the very same day, wherein the defacto complainant is the accused and he has been granted regular bail by the learned Principal District Judge, Thanjavur in Crl.M.P.No.3133 of 2022 on 23.06.2022.
4.The learned Government Advocate submitted that the injured sustained several injuries, out of which, one of the injury is head injury and 22 stitches were put-up for that injury. However, in both cases injured were discharged form the hospital. https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.11197 of 2022 5.Perusal of FIR and other records, it is seen that both sides sustained head injuries and discharged from the hospital. Considering the previous enmity between the parties and the period of incarceration undergone by the petitioner, this Court is inclined to grant bail to the petitioner with stringent conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Pattukottai, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
