For Respondent : Mr.T.Senthilkumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Cr.No.120 of 2021 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners, apprehending arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 449, 324, 307, 302 and 506(ii) I.P.C in Crime No.120 of 2021, seek anticipatory bail.

2.The case of the prosecution is that on 21.04.2021 at about 3.00 p.m, the petitioners along with other accused persons has trespassed into the defacto complainant's house, attacked her husband with aruval and caused his death. Hence, the complaint. 3.The learned counsel for the petitioners would submit that the petitioners are innocents and they have not committed any offence as alleged by the prosecution.

CRL OP(MD)No.10230 of 2021 4.The learned Government Advocate (Crl.side) appearing for the respondent police would submit that totally 10 accused in this case. The petitioners are accused nos.8 and 9. Accused Nos.1 to 7 were arrested and remanded to judicial custody. He would further submit that these petitioners were also present in the place of occurrence and have committed the offence. The first petitioner is the friend of accused no.1 and the second petitioner is the brother of accused no.3. Hence, he strongly opposed for grant of anticipatory bail to these petitioners.

5.Considering the role of these petitioners in the alleged offence, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
