ORDER

The Writ Petition is filed seeking direction to the first respondent to disburse the compensation amount in respect of the land situated in Survey No.1923/1D2 acquired for extension of National Highways.

2. The petitioner submitted a representation before the first respondent on 26.02.2025 seeking disbursal of the compensation amount, which has been withheld by the first respondent due to the objection raised by the second respondent. The said representation has not been considered. Hence, the petitioner has come before this Court.

3. If there is a genuine dispute with regard to the person entitled to claim compensation amount, the first respondent should refer the matter for the decision of the Civil Court and he is not entitled to withhold disbursal of the compensation amount. Therefore, the first respondent is directed to consider the representation of the petitioner dated 26.02.2025 and pass final orders on its own merits within a period of twelve (12) weeks from the date of receipt of a copy of this order after issuing notice to the petitioner and the second respondent. In case of dispute as to the person to claim compensation amount, it

is for the first respondent to refer the matter to the Civil Court in the light of Section 3H(4) of the National Highways Act.

4. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
