Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order in Na.Ka.No. A3/0371/2019 dated 10.02.0222 on the file of the Respondent No.2 and quash the same as illegal and consequently direct the Respondent No.1 and 2 to award the tender in favour of the petitioner for running the bar attached to TASMAC shop bearing Number 11854, 263/A2 Ward No.9, Sengamala Nachiyar Puram Road, Thiruthankal, Sivakasi Taluk, Virudhunagar District for the period 01.01.2022 to 31.12.2023 within the time frame stipulated by this Court.

ORDER

The present writ petition has been filed challenging the confirmation of the auction in favour of the third respondent herein for collecting the empty bottles and for selling snacks in the TASMAC bar. 2.According to the learned counsel appearing for the petitioner, the Demand Draft obtained by the petitioner was used by the third 2/4

respondent herein for obtaining the said contract. However, on perusal of the Demand Draft, it does not stand in the name of the writ petitioner, but stands in the name of one Sanjeevi Rajan. In these circumstances, the petitioner has to work out his remedy against the third respondent, and such a prayer is not maintainable as against the respondents 1 and 2. 3.Granting such liberty to the writ petitioner, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
