Respondents (4th respondent is impleaded vide Court order dated 07.07.2025 made in W.M.P.Crl(MD) No.119 of 2025) PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to release the petitioner, namely, Ganesan, aged about 72 years now confining at Madurai Central Prison on the basis of the Advisory Board proceedings in accordance with Rule 341of the Tamil Nadu Prison Rules 1983 in accordance with law within the time stipulated by this Court.

ORDER
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) The petition has been filed seeking a direction to the respondents to release the petitioner, namely, Ganesan, aged about 72 years, now confined at Madurai Central Prison, on the basis of the Advisory Board proceedings, in accordance with Rule 341 of the Tamil Nadu Prison Rules 1983 within the time stipulated by this Court.
2.A status report has been filed by the third respondent. The relevant portion is extracted hereunder:- 4.It is submitted that the Life Convict Prisoner No.3382 Ganesan, S/o.Shanmugam Pillai has completed 14 years of imprisonment as on 30.01.2025 and hence the prisoner's case has been considered for premature release as per prison Rule o.348 of Tamil Nadu Rules 2024. The reports of the probation Officer, Madurai and District Collector, Madurai have been called for vide this Office Letter No.264/R1/2024, dated 24.01.2025. The report of a Probation Officer, Madurai has been received in this Office on 03.02.2025. A reminder letter was sent to the District Collector, Madurai vide this Office letter No.264/R1/2024, dated 22.04.2025. The report of District Collector, Madurai is awaited. On receipt of the report from District Collector, Madurai, a complete proposal will be sent to Office of the Director General of Prisons and Correctional Services, Chennai, for onward submission to Tamil Nadu Government for cosnideration of the petitioner's premature release.
3.The learned Additional Public Prosecutor appearing for the respondents submitted that the representation of the petitioner is under process and it will be dealt with as expeditiously as possible.
4.Recording the said submission, this Writ Petition is disposed of with a direction to the respondents to consider the representation of the petitioner and pass orders as expeditiously as possible, preferably within a period of twelve weeks from today. No costs. Consequently, connected miscellaneous petition is closed.
