O R D E R
Heard the learned counsel on either side.
2. The writ petitioner studied B.E. in the second respondent college. Since the course has already been successfully completed, the second respondent college has also issued Transfer Certificate. In the said certificate, the petitioner's nationality has been mentioned as Indian.
3. From the materials on record, I am more than satisfied that the petitioner is a Malaysian national as well as citizen. A copy of the passport issued by the Malaysian Government has also been enclosed in the typed set of papers. The SSLC Transfer Certificate was issued by the Alpha Wisdom Vidyashram Senior Secondary School(CBSE), Trichy. In the said certificate, it has been mentioned that the petitioner is a Malaysian National. However in the Transfer 2/5
3 W.P.(MD)NO.12697 OF 2022 Certificate issued by Chelammal Matric Higher Secondary School, Trichy, the petitioner's nationality has been inadvertently mentioned as Indian. But this was omitted to be noted during the relevant time. The same mistake crept in the Transfer Certificate issued by the second respondent college also. Such records pertaining to the petitioner will have to be corrected. Otherwise, the petitioner may be put to hardship and difficulty in future. Since I am satisfied that the mistake pointed out by the petitioner had been inadvertently done, the second respondent is directed to issue fresh Transfer Certificate by mentioning the nationality of the petitioner as Malaysian.
4. The second respondent college had admitted the writ petitioner in the Engineering course by proceeding on the premise that the writ petitioner is an Indian. As a result of the correction needed to be issued, the second respondent college will not be put to any consequence. I reiterate that only pursuant to the direction given by this Court, the second respondent college has been asked to issue the Transfer Certificate in question with the aforesaid correction itself. 3/5
