ORDER

Heard both sides.

2. One Chandran filed W.P.(MD)No.20822 of 2022 challenging the order dated 01.08.2022 passed by the District Registrar (Admn), Madurai City. I granted stay on condition that by recording the undertaking of Chandran that he will not deal with the petition-mentioned property or create any kind of encumbrance till the disposal of the writ petition. The contempt petition came to be moved on the footing that in breach of the said undertaking, Chandran sold the property in favour of one Thevaraj Soloman.

3. When the statutory notice was issued to Chandran, he submitted that he withdrew the writ petition on 28.08.2024 and thereafter only, sold the property. Technically, Chandran may not be guilt of contempt. But it 3/6

is beyond dispute that he played fraud on the process of this Court. Further, it is seen that Chandran had purchased the property from one Jeya Lakshmi. Jeya Lakshmi in turn purchased the property from one Muthuvel. Muthuvel claims to have purchased the property from the power of attorney / one Sakunthala. Sakunthala in whose name the property stood is none other than the mother of the petitioner. The petitioner's mother was passed away way back in the year 2003. The power of attorney was created in the year 2017. I therefore directed the jurisdictional police to register a criminal case. It appears that one Ramar had played a central role. I impleaded Ramar and asked the police to produce him before me. But today, the police informed me that Ramar passed away on 05.07.2025. Copy of the death certificate of Ramar has also been furnished.

4. In these circumstances, the petitioner may have to move the jurisdictional civil Court. The Sub Registrar, Thiruparankundram is restrained from entertaining any document pertaining to the subject property for a period of two years. I give such a restraint order since the petitioner undertakes before this court that he will file a comprehensive 4/6

civil suit within four weeks from the date of receipt of a copy of this order. If the papers are in order, the suit shall be numbered. Since all the contesting respondents are before me, they shall enter appearance in the suit to be filed by the petitioner without adopting any dragging on tactics. The trial Court shall dispose of the matter on merits and in accordance with law within a period of one year thereafter.

5. With the aforesaid directions, the contempt petition is disposed of.
