PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 5 to take necessary action against the 6th respondent for his illegal medical practice as a Doctor in and around Uppukkottai Village of Theni District and consequently, take steps to close the hospital of the 6th respondent.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ on hand has been instituted to direct the respondents 1 to 5 to take necessary action against the 6th respondent for his illegal medical practice as a 2/5

Doctor in and around Uppukkottai Village of Theni District and consequently, take steps to close the hospital of the 6th respondent. 2.The learned counsel appearing for the petitioner would submit that the 6th respondent is not a qualified medical practitioner and he is having registration certificate only to run pharmacy and not to provide treatment to the general public. 3.The learned counsel appearing for the 6th respondent would oppose by stating that the wife of the 6th respondent is having registration certificate to run the hospital.

4.It is brought to the notice of this Court that the petitioner died. May that as it be, this Writ Petition is a Public Interest Litigation. Therefore, the genuineness of the certificate obtained by the wife of the 6th respondent is to be verified. It is needless to state that the authorities competent are bound to verify the genuinity of the certificate and if it is found to be not genuine, all appropriate actions are to be initiated in the manner known to law. 3/5

5.With the above observation, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
