ORDER : The Court made the following order :- On the earlier occasion (i.e) on 17.05.2023, after hearing both side counsels, the matter was referred to the Mediation Centre for settlement. Therefore, interim anticipatory bail was granted to the petitioner.
2. On 07.08.2023, when the matter was taken up for hearing, the learned counsel for the intervenor would submit that the second accused has tried to attack the defacto complainant, during the mediation process.
3. The learned counsel for the petitioner would submit that the defacto 1/3
complainant also made an assault on the petitioner.
4. All the offences are committed by the petitioner and all the offences are serious in nature. There is no settlement between the parties. I find no reason to make absolute the interim anticipatory bail granted to the petitioner.
5. On 07.08.2023 itself, at about 01.00 p.m, after hearing both side counsels, considering the conduct of this petitioner, this Court observed that this petition deserves dismissal and accordingly, the same is liable to be dismissed.
6. On the very same day, at about 02.30 p.m, the learned counsel for the petitioner submitted that the final report has been filed before the concerned Court by deleting the offence under Section 376 of IPC and adding the offence under Section 493 of IPC. Therefore, at request of the petitioner, this Court directed to list the matter today (i.e) on 09.08.2023 for further hearing. 7.Considering the conduct of the petitioner before the mediation centre, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original petition is dismissed.
