PRAYER :- For Bail in Crime No.192/2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/A4, who was arrested on 06.06.2022 for the alleged offence under Sections 341, 294(b), 323, 307 and 506(ii) of IPC, in Crime No.192 of 2022 on the file of the respondent police, seeks bail.
2.The case of the prosecution is that on 05.06.2022 at about 5.00 p.m, a trouble arose between the parties, in which the petitioner said to have assualted the defacto complainant with knife and wooden log and caused injuries to him. Hence, the complaint.
3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) appearing for the respondent police. 1/3
4.On perusal of records, it shows that the petitioner has moved a bail application before the Principal District Judge, Tirunelveli in Cr.M.P.No.5020 of 2022, wherein it is stated that the injured is still taking treatment in the hospital. On that ground, that petition was dismissed on 17.05.2022.
5.Now, this petition has been filed mainly on the ground that the petitioner is studing 3rd year B.Com and his examination to be conducted by the university from 22.06.2022 to 27.06.2022. 6.The learned Government Advocate(Crl.side) submitted that as per the information furnished by the concerned police, no one was injured in the said occurrence and the same is contrary to the information mentioned in the FIR.
7.Whatever it may be, the injured has been discharged from the hospital and the petitioner has to sit for examination from 22.06.2022 to 27.06.2022.
8.In view of the urgency, the petitioner is directed to be released on his executing own bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) before the Superintendent of Police, Central Prison, Palayamkottai. Further, the petitioner need not report before the concerned Court till 27.06.2022. Later i.e. 28.06.2022, the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Tirunelveli and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders from 28.06.2022.
