ORDER

This petition has been filed to dispose CC.No.368 of 2016 pending before the learned Judicial Magistrate No.II, Kannyakumari at Nagercoil, within a time frame as fixed by this Court.

2. According to the petitioner, he is the accused in this case and case in C.C.No.368 of 2016 is pending from the year 2016 onwards without further progress. Hence, he filed this petition for speedy disposal.

3. The learned Government Advocate (Crl.side) appearing for the first respondent, on instructions, submits that case is posted for examination of further witnesses and already five more witnesses were examined.

4. Considering the prayer sought for in this petition, this Court even without issuing notice to the second respondent, is inclined to pass order in this petition.

5. Since the case in C.C.No.368 of 2016 is pending before the trial Court from 2016 onwards and now the case is posted for examination of further witnesses and already five more witnesses were examined, considering the prayer sought for in this petition, this Court directs the learned Judicial Magistrate No.III, Kanyakumari at Nagercoil, to complete the proceedings in C.C.No.368 of 2016 within six months from the date of receipt of a copy of this order.

6. With the above direction, this Criminal Original Petition is disposed of.
